JobDuties/Responsibilities:
Describetheduties
Commercial tree planting will be conducted on steepterrain;40%-60%inslopeanddonewith the use of a planting shovel. The employee will (scalp) clear a space on the ground,dig a hole, correctly place the seedling tree in the hole, cover the roots with the soil, andthen tamp the soil around the newly planted seedling. The employee will be required tocarryaplantingbagwhichwillcontaintheseedlings,thecombinedweightisabout50-60pounds, depending on the size of the seedlings, up and down the steep terrain in remotemountainous areas.
Pre-commercial thinning: cutting of undesirable and diseased trees. Spraying vegetation toeliminate unwanted underbrush. Brush cutting/piling and the cutting of limbs of thecommercialtimberwillbeconductedinordertopromotethegrowthofthestandingtimbertree limbs cut and brush will be piled in a prescribed manner for future disposal.
The thinning will be conducted with the use of a chainsaw. Employees are expected tomaintain the saw, sharpen the chain in the field, maintain correct fluid levels, and properlybreak the saw down for cleaning. The combined weight of the saw, fuel and oil isapproximately30lbs.andmustbecarriedupanddowndifficultterrainrangingfrom40%-60% in slope. The employee must demonstrate that he can work in a safe and effectivemanner. Access is gained to these remote
areasbytravelingonabandoned, unnamedornumbered,loggingroadsthataremaintained.
JobRequirements/Qualifications:
Requirements: 3 months experience performing commercial tree planting and/or pre-commercial thinning. Must be available to work in each of the counties named andcomplete the entire season. No education requirements are needed, training available ifneeded.Resumeshowing3monthsexperienceneededattimeofinterview.Transportationprovided by the company to and from the worksites at no expense to the employee. Workwill be performed in the following counties -

STATEOFOREGON:Baker,Benton,Clackamas,Clatsop,Coos,Columbia,Deschutes,Douglas, Grant, Hood River, Jefferson, Lane, Lincoln, Linn, Marion, Multnomah, Polk,Tillamook, Umatilla, Union, Wallowa, Washington, Yamhill, Wasco and Sherman.

GeneralJobSpecifications:
Disclosure of work contract: Employer will provide a copy of this document to any H‐2B worker, in a languageunderstoodbytheworkerasreasonableper20CFR655.20(I),nolaterthanthetimeatwhich
theworkerappliesforthevisa,orforaworkerincorrespondingemployment,nolaterthantheday work commences.
Full Season Commitment: The worker agrees to the job offer to be available for work every day that workisavailableforthefullperiodofemploymentstartingdateOctober1st,2024,endingondateJune30, 2025.
HOURS/DAYS/SCHEDULE:
Hours: 40 hours a week, 7am to 3:30pm, Monday through Friday. Occasional overtime is expected.
Thecompanyguaranteestoofferworkforhoursequaltoatleast3/4oftheworkdaysin each 12-week period of total employment.
WageRatesandSpecialPayInformation:
Wagerangesfrom$17.31to$24.28perhour,dependingonthecountyinwhichworkisperformed.
Shouldtherebeanyovertimefortheweek,itwillbepaidatthe1.5rateofthecountywherethework is performed, (ranging from $ 25.97 to $ 36.46, respectively).
The company will use a single workweek as its standard for computing wages due. Workers are paid every two (2) weeks. The company will make all deductions from the worker's paycheck required by law.
If the prevailing wage is increased by the U.S. Department of Labor during the season, the employee's wage will increase accordingly.
- The Employerwillprovide sickleave to employees. Theemployee willaccrue paidsick leaveataminimum rateof 1 hour for every 40 hours worked.Employees are entitled to use accrued paidsick leave beginning on the 90thcalendar day after the start of their employment, and sick leavewillbepaidattheemployee’snormalhourlyrate.Unusedpaidsickleaveof40hoursorlesswillbe carried over to the following year for those workers returning to employment with theemployer.
Deductions,benefits,andotherdetailsaboutpay:
- The employer will make the following deduction from the worker’s wages: FICA Taxes, Federalincome tax if required, other deductions expressly authorized or required by state or federallaw,cashadvancesandrepaymentofloans,repaymentofoverpaymentofwagestotheworkerpayment for articles which the worker has voluntarily purchased from the employer, long‐distance telephone charges, recovery of any loss to the employer due to the worker’s damage(beyondnormalwearandtear)andanyotherdeductionsexpresslyauthorizedbytheworkerinwriting.
- Theemployerwilldeductaportionofworker’scompensationpremiumfromworkers’payasspecified in Washington law at RCW 51.61.140.
- Theemployerwillwithholdfromtheemployee’swagesthemaximumamountfortheportionof employee premium required under WA State RCW 50A.04, Paid Family and Medical Leave Program.
Housing/LodgingAccommodations:
Inbound:
Ifrelocationisrequiredbyaworkerwhoishired,whodoesnotresideintheareaofemployment,whether in the U.S. or abroad, travel expenses and subsistence will be paid to each worker by thecompany based on what is specified under 655.173 transportation (including meals, at least
$15.88aday,nottoexceed$59.00adayand,totheextentnecessary,lodging,nottoexceed
$100.00 a night, receipts required), from their current abode to the place of employment, LEWIS County, WA, if the worker completes 50% of the employment period covered by the job order, which is consistent with 20CFR655.20(j)(1)(i). Payment of said expenses and subsistence will be paid within 3 days after the completion of the 50% of the contract period by check, paid to the worker. The employer will assist in helping locate optional housing which is paid by theemployee in the Lewis County Area.
Mt. St. Helens Reforestation will reimburse the H-2B worker in the first workweek for all visa, visa processing, border crossing and other related fees, including those mandated by the government, incurred by the H-2B worker.
Outbound:
The company will pay return transportation and daily subsistence to the area from which the worker left from in order to take this job when the worker completes the employment period or is dismissed from employment for any reason by the employer before the end of the period.
Tools&Equipment:
The company/employer will provide workers at no charge all tools, supplies and equipment required to perform the job, as per 20CFR655.20(k).
Transportation:
When required, hotel accommodations are provided by the company at no cost to theemployeewhenworkisconductedoutsideofthenormalcommutingareaofLewisCounty.
PerCFR655.20(j)(1)(i)theemployerwilleitherprovideorreimbursetheworkerfortransportationand subsistence from the place from which the worker has come to work for the employer, whether in the
U.S.orabroad,totheplaceofemploymentiftheworkercompletes50percentoftheperiodof employment covered by the job order (not counting any extensions).
TheemployerwillreimbursetheH‐2Bworkerinthefirstworkweekforallvisa,visaprocessing,border crossing, and other related fees, including those mandated by the government, incurred by the H‐2B worker.
The employer will arrange and pay for the transportation and subsistence directly, advance at a minimum the most economical and reasonable common carrier cost of the transportation and subsistence to the workers before the worker’s departure or pay the worker for the reasonable cost incurred. The amount of the transportation payment will be no less (and is not required to be more) than the most economical and reasonable common carrier transportation charges for the distance involved. The rate of reimbursement for subsistence during transportation is $14.00 per day if no receiptsareoffered,uptoamaximumof$59.00per dayiftheWorkerpresentsreceiptsasspecifiedin 20 CFR 655.122(h)(1) and 20 CFR 655.173(a). Employer will provide or pay for reasonable lodging accommodations when applicable.
OtherConditionsandAssurances:
Three‐fourthsguarantee:(1)Theemployermustguaranteetooffertheworkeremploymentforatotal number of work hours equal to at least three‐fourths of the workdays in each 12‐week period (each 6‐ weekperiodiftheperiodofemploymentcoveredby thejoborderislessthan120days)beginningwith the first workday after the arrival of the worker at the place of employment or the advertised first date of need, whichever is later, and ending on the expiration date specified in the job order or in its extensions, if any.
